These Terms of Use, including this End User License Agreement ("Terms," "EULA"), form a binding agreement between you and Shape regarding the Shape: BMI Calculator mobile application and this website (the "Licensed Application" or "Service").
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not download or use the Service.
These Terms are intended to satisfy customary App Store / Google Play requirements for a custom EULA, including license scope, restrictions, subscriptions, disclaimers, and liability limits. Where Apple's Standard EULA would otherwise apply, these Terms govern to the extent permitted; nothing here overrides mandatory consumer rights.
1. Parties & Apple as third-party beneficiary (iOS)
The Licensed Application is licensed to you by Shape (the developer/publisher of com.aandistudio.shape), not by Apple. Apple has no obligation to provide maintenance or support for the Licensed Application.
You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the iOS app, and that upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
2. License grant
Subject to these Terms, Shape grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Licensed Application on devices you own or control, solely for personal, non-commercial purposes, as permitted by the Apple Media Services Terms / App Store Usage Rules or Google Play Terms of Service (as applicable). This license does not transfer ownership of the Licensed Application or any intellectual property.
3. License restrictions
You may not:
- Copy, modify, distribute, sell, lease, rent, or sublicense the Service except as expressly allowed
- Reverse engineer, decompile, or disassemble the Service except to the extent mandatory law permits
- Bypass, disable, or interfere with security, entitlements, or subscription checks
- Use the Service to infringe others' rights, upload malware, or violate law
- Scrape or bulk-extract content in a way that harms the Service
- Use the Service, or the estimates it produces, as a substitute for professional medical diagnosis or treatment decisions
4. Description of the Service
Shape helps users calculate BMI, body fat percentage, BMR/TDEE, and waist-to-hip ratio, track a history and trend of their measurements, work through an optional 31-day habit challenge, and sync weight and steps from Apple Health. Features may change. Premium features ("Shape+") require a paid subscription.
5. Not medical advice / wellness disclaimer
SHAPE IS A SELF-HELP CALCULATOR AND TRACKING TOOL. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL, PSYCHOLOGICAL, CLINICAL, OR THERAPEUTIC ADVICE, DIAGNOSIS, OR TREATMENT.
BMI, body fat, BMR/TDEE, and waist-to-hip ratio figures use standard published formulas (such as the Mifflin-St Jeor equation and the U.S. Navy method) applied to numbers you enter, and are approximations only.
If you have concerns about your weight, body composition, or general health, consult a qualified healthcare professional. Do not delay seeking care because of information shown in the app.
6. Eligibility & age
You must be at least 13 years old, or the minimum age required to consent to online services in your country (whichever is higher). If you are under the age of majority, you represent that you have parental/guardian consent where required.
7. User content
You retain ownership of the measurements, goals, and any other content you enter into the app. Since this content is stored locally on your device, Shape does not host, reproduce, or display it except as needed to run the app's own features on your device.
8. In-App Purchases & auto-renewable subscriptions (required store disclosures)
Shape offers a free calculator and an optional paid Shape+ subscription, currently available as Weekly, Monthly, and Yearly plans. The Yearly plan may include a free trial period (currently 7 days) for eligible new subscribers, as shown in the app and store listing at the time of purchase.
Payment: Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
Management & cancellation: You can manage and cancel your subscription in your account settings after purchase:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play → Payments & subscriptions → Subscriptions
Trials: If a free trial is offered on the Yearly plan, it converts automatically to a paid subscription at the end of the trial unless canceled beforehand, subject to store rules.
Pricing: Prices are shown in the app/store listing at purchase and may vary by region and applicable taxes.
Refunds: Refunds are handled by Apple or Google under their respective refund policies, except where mandatory consumer law requires otherwise. Shape does not directly process card payments.
9. Premium features (Shape+)
Shape+ unlocks Body Metrics (BMR, TDEE, body fat, waist-to-hip ratio), unlimited measurement history, the full 31-day challenge, and Apple Health sync. We may modify Shape+ benefits with reasonable notice where required by law.
10. Intellectual property
The Service, including its software, design, text, graphics, and the "Shape" name and logo, is owned by Shape or its licensors and protected by intellectual property laws. These Terms do not grant you any right to use our brand except as needed to use the Licensed Application.
11. Third-party services
The Service depends on third parties including Apple, Google, and RevenueCat (subscription management). Their terms and privacy policies apply to their respective services. We are not responsible for third-party outages or policies beyond our reasonable control.
12. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that Policy.
13. Maintenance & support
Shape is solely responsible for providing maintenance and support for the Licensed Application as required under these Terms or applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services regarding the iOS Licensed Application.

14. Updates
We may issue updates, patches, or new versions. Some updates may be required to continue using the Service. Store platforms may also update delivery of the app under their own rules.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY ESTIMATE, TREND, OR CHALLENGE WILL ACHIEVE ANY PARTICULAR HEALTH OUTCOME.
Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent permitted.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAPE AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO SHAPE FOR SHAPE+ IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for fraud or for death/personal injury caused by negligence where such exclusion is prohibited).
iOS note: In the event of any failure of the Licensed Application to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Licensed Application (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Licensed Application.
17. Product & intellectual property claims (iOS)
Shape, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application, including product liability claims, any claim that the Licensed Application fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar legislation. Shape, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property claim related to the Licensed Application.
18. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Shape from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.
19. Termination
These Terms remain in effect until terminated. Your rights under the license terminate automatically if you fail to comply with these Terms. You may stop using and delete the app at any time. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) survive termination.
20. Changes to the Terms
We may update these Terms. We will revise the "Last updated" date and may provide notice in the app or website for material changes. Continued use after changes become effective constitutes acceptance, except where mandatory law requires additional consent.
21. Governing law & disputes
These Terms are governed by the laws applicable in the publisher's country of establishment, excluding conflict-of-law rules, except that mandatory consumer protection laws of your country of residence continue to apply where required.
22. Severability & entire agreement
If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any in-app purchase disclosures, constitute the entire agreement regarding the Service and supersede prior agreements on the subject.
